Wait! You Can’t Ask About Salary History?

The Implications on Talent Acquisition and Beyond

Asking candidates to reveal their salary history is becoming, at best, socially unacceptable, and, at worst, illegal in many state jurisdictions. With the overarching objective of preventing employers from asking salary-related questions or from screening job candidates based on salary histories, this legislative and social trend is gathering strength especially with the resurgence of the women’s movement.  In this session, a panel of diverse industry professionals have been brought together to share their unique perspectives and will discuss what recruiters and employers need to do now, and in the future, to prepare for the longer-term implications of this movement.

Questions to be addressed by this discussion may include:

  • What are the operational and systems implications of this new regulation?

  • What if the candidate offers their past or current compensation without being asked?

  • How do you roll out a policy nationally when not every state is required to comply?

  • What are the penalties proposed for violation in states where this is now the law?

  • How do you evaluate sales talent performance and determine a compelling offer when you can no longer ask about their past compensation plan structure and income?

  • How do you structure a competitive executive compensation package without context of past comp plans and structure?
